Terms of Sale

These terms apply to the purchase of ZoneBuddy Premium (plans “Plus” and “Pro”) via zonebuddy.de or app.zonebuddy.de. The provider and your contractual partner is Benedict Schlegel (email: billing@zonebuddy.de; full details in the Imprint).

The use of ZoneBuddy as a whole is additionally governed by the Terms of Use. Deviating terms of customers do not apply.

ZoneBuddy’s basic features are free. Premium unlocks additional features for one specific Discord server. The features included in a plan are shown on the Premium page and in the dashboard at the time of ordering. Premium applies to the server selected at purchase and cannot be transferred to other servers.

We strive for uninterrupted operation. However, ZoneBuddy depends on third-party services (in particular Discord, hosting and AI providers); short interruptions, e.g. for maintenance or due to disruptions of these services, are possible. Your statutory rights in the event of defects (§ 9) remain unaffected.

The presentation of the plans does not constitute a binding offer. You choose the plan and term, sign in with Discord and select the server. You enter your details on the checkout page of our payment provider Stripe. By clicking the buy or subscribe button, you submit a binding offer; the contract is concluded when Stripe confirms the payment or subscription and we unlock Premium. You receive the confirmation by email (Stripe) and as a message from ZoneBuddy in Discord.

The language of the contract is German. We do not store the contract text separately; you can view and save these terms here at any time, and you receive the invoice by email.

The prices displayed at the time of ordering apply. All prices are final prices. Payment is processed by Stripe Payments Europe, Ltd. (Ireland); the payment methods offered there are available. Subscriptions are due in advance at the beginning of each billing period, Lifetime once at purchase. Discount codes can only be redeemed on the checkout page; they are non-transferable and cannot be paid out in cash.

If a payment fails, Stripe will retry it and notify you. If payment is not made, Premium ends when the paid period expires.

A free trial may be offered with the first subscription for a server (currently 7 days; the information shown when ordering is decisive). If you cancel before it ends, no costs are incurred. Otherwise, the trial automatically converts into the selected paid subscription. We remind you by email before the trial ends. There is one trial per server.

Monthly subscription: term of one month, renews for one month at a time unless you cancel before it expires. You can cancel at any time effective at the end of the current month.

Yearly subscription: the initial term is one year. If you do not cancel before it expires, the subscription continues for an indefinite period and can then be cancelled at any time with one month’s notice. If you have already paid for the period after the end of the contract, we refund that portion pro rata.

How to cancel: in the dashboard under Premium → “Manage subscription”, via the cancellation button at zonebuddy.de/en/cancel or by email to cancel@zonebuddy.de. You will receive a confirmation. The right of both parties to terminate for good cause remains unaffected.

After Premium ends, all server data is kept; only the Premium features are switched off (e.g. custom bot avatar → default image, custom bot → back to ZoneBuddy).

“Lifetime” is a one-time payment without a subscription. It applies to the selected server for as long as we operate ZoneBuddy. If we discontinue ZoneBuddy within 24 months of your purchase, we refund the purchase price pro rata for the remaining months of that period. A subscription for the same server running at the time of purchase ends at the end of its billing period.

The statutory rights for defects in digital products apply (§§ 327 et seq. of the German Civil Code, BGB).

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In cases of slight negligence, we are only liable for breach of an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance you may regularly rely), limited to the typical, foreseeable damage. We are not responsible for data within Discord or for decisions made by Discord (e.g. suspension of servers or bots).

If a server or user seriously violates the Terms of Use or Discord’s rules, we may block ZoneBuddy for that server and terminate the contract for good cause. Statutory refund claims remain unaffected.

Price changes only apply to new billing periods. We announce them by email at least six weeks in advance; you can then cancel effective at the time of the change. Lifetime purchases are not affected by price changes. We continue to develop features; we only make significant restrictions to a paid plan in accordance with the statutory requirements (§ 327r BGB).

The data we process when you make a purchase is described in the Privacy Policy (section “Premium and payment”).

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, just write to us: billing@zonebuddy.de.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence. Should any provision be invalid, the remaining provisions remain valid.
